LAS CRUCES (KRWG) - Third Judicial District Court Chief Judge Jerald A. Valentine of Las Cruces has ruled in favor of a request by Las Cruces Public Schools for a preliminary injunction against the school district's bus contractor, First Student, Inc. The ruling prevents the bus company from terminating its fleet service contract "except upon 60 days' notice to the (school district)."
"We are very pleased with the court's decision," said LCPS Superintendent Stan Rounds. "This now ensures the district will have school bus transportation for its students for the remainder of this school year."
In a March 15, 2010 letter to Rounds, First Student said it planned to discontinue school bus service to the district on March 31, 2010. LCPS was granted a temporary restraining order March 24, which prevented the company from terminating its contract without a minimum of 60 days' notice, which is a part of the contract with LCPS.
Valentine's ruling reiterates that the notice must be done in accordance with the contract, stating, "Cancellation of the contract shall be effective only after the (School) Board grants written consent" and notice must also be provided to the State Transportation Director of the Public Education Department.
Valentine went on to rule that "if the Court does not issue the preliminary injunction, the Board of Education and its students will suffer immediate and irreparable harm. Transportation to and from school cannot be arranged if First Student immediately cancels the contract."
Attorneys for LCPS and First Student appeared before Valentine April 16 in a five-and-one-half-hour hearing on LCPS' motion for the preliminary injunction. Each side presented written final arguments April 21, and Valentine issued his ruling today, Thursday, April 22, 2010.
First Student owns and operates a fleet of 136 buses that transports about 9,200 students from home to school and back each school day. First Student's contract with LCPS is through June 30, 2010.

San Francisco City Bus Strikes And Kills Pedestrian
The operator of the Muni bus that fatally injured a 49-year-old man on Wednesday in the Financial District had been driving for the transit agency for just over two years at the time of the crash.
Scott Whitsett, 49, was killed after stepping onto the rain-slicked pavement of Mission Street on Wednesday afternoon, where he was struck by a 14-Mission bus being driven by Kimberly Johnson.
After the initial impact, Whitsett was then pinned against another nearby Muni bus, a 14-Mission Limited helmed by Cedric Geegan, a seven-year veteran.
The accident occurred at about 11 a.m., and Whitsett was extricated and transported shortly afterward to San Francisco General Hospital, where he succumbed to his injuries.
Both Johnson and Geegan were tested for drugs and alcohol and placed on nondriving status following the incident, which is standard Muni procedure according to spokeswoman Kristen Holland. Johnson, who was seen visibly upset following the accident, began operating Muni buses on April 7, 2008, while Geegan started on April 28, 2003, according to Holland.
The accident is currently being investigated by the San Francisco Police Department, which is reviewing video footage capture by onboard Muni cameras.
Wednesday’s accident was the first Muni-related fatality of this year.

on Monroe. The pickup hit the bus on the right side.
The injured girl was among five children on the bus. Police say she has a minor
injury; a bump on her head. All of the other children are okay.

The accident occurred around 7 a.m. at 5803 Medlin Road near Quail Run Road
which is south of Monroe.
Luan Ingram, spokeswoman for Union County Public Schools, said the amber lights
on the bus were flashing at the time of the crash, but the stop light arm on the
bus was not deployed when the 7-year-old boy ran across the road.
The bus was heading to Union Elementary School and several students were on the
bus at the time.
Dewayne Thomas was driving the van which struck the first grader. Thomas was
heading in the opposite lane in which the bus was in. He said there was nothing
he could to avoid hitting the boy.
According to the highway patrol, the boy was thrown about 78 feet after making
impact with the van.
The boy suffered life-threatening injuries and was transported to the Levine's
Children's Hospital in Charlotte.
As of 1 p.m., the highway patrol said the child was alive and on life support.
Back at the school, additional counselors were made available for students.
Ingram said the counselors spoke individually to each student who was on the bus
as well as their parents about what happened.
The North Carolina Highway Patrol is investigating the accident.

MATA bus, tractor trailer involved in crash
MEMPHIS, TN (WMC-TV) – Memphis police and emergency officials responded to an accident Friday morning between a MATA bus and a tractor trailer.
"It was like a rollercoaster ride," passenger Rodrickus Taylor said.
Officials said 23 adults and two children were on the bus when it turned left off Getwell on to American Way. As the bus turned, an 18-wheeler suddenly struck its front door. The bus received heavy damage, slamming into a pole that holds high tension wires.
A witness described the accident scene as "pure chaos" as passengers on the bus tried to exit it after the collision.
"Everybody was screaming and hollering, and I was trying to get to people," Joe Porter said.
Porter and other witnesses tried to help as family members began showing up.
"My friend called me and said the MATA bus bad been hit by an 18-wheeler," Amanda Bray said.
Ambulances transported eight people to the hospital, while the other passengers were put on a second bus and taken to a hospital to be checked out.
Battalion Chief Brad Rust of the Memphis fire Department said no one was seriously injured.
"Just some various minor injuries," he said.
But at the hospital, Brittany Harbin was worried about her mother, who was on the bus.
"Her arm is broken and her head is injured," Harbin said.
The driver of the tractor-trailer declined treatment at the scene.
According to a Memphis Police Department spokesperson, the driver of the bus was cited for making an improper left turn and failure to maintain a safe lookout.

Naivasha- Maai Mahiu road in Kenya's Rift Valley province.
The 5.am. accident occurred after a bus travelling from Busia to the capital
Nairobi collided with a trailer on the busy highway.
Police said that the trailer was overtaking a stationary vehicle and the driver
lost control causing the deadly collision, which left 45 injured.
A turnboy from the trailer was among the eight dead at the scene, while two
others died on the way to Naivasha District Hospital.
The bus driver escaped unhurt as the trailer rammed into the bus from the side
but the other 60 passengers were not so lucky.
The injured were rushed to Kijabe Mission Hospital.

Asheville bus driver involved in 5 wrecks since 2007
ASHEVILLE — The city bus driver who blacked out behind the wheel before hitting a woman on the sidewalk had been involved in four accidents since 2007, according to police wreck reports.
Ralph Dowdle, 52, of Arden, wasn't ticketed in any of the accidents, including the accident Saturday on College Street.
A police accident investigator said an undiagnosed medical condition caused Dowdle to lose consciousness. His bus damaged three businesses and left 55-year-old Susan Jane Zakanycz with serious injuries.
His company, Transit Management of Asheville, declined to discuss any prior wrecks, citing a personnel policy.
In April 2009, a car ran a stop sign at Hudson and State streets and pulled in front of his bus, according to a witness's statement to police. A month before that, a car sideswiped his bus on Hendersonville Road near All Souls Crescent.
In 2008, his bus sideswiped a car on Michigan Avenue near Alabama Avenue. The car's driver had parked on the roadside across from another to check her mail and the bus hit her car while trying to fit between the two cars.
The year before that, a drunken pedestrian stumbled in front of his bus on NC 81. The pedestrian wasn't hurt but was arrested for being intoxicated in public.
Dowdle had a valid passenger rated commercial driver license on Saturday. The state doesn't typically revoke a commercial driver license for minor wrecks.Wednesday, April 21, 2010
Sexual incidents on buses
Detectives are appealing for information from the public to identify a man they wish to speak with following three incidents of a sexual nature that occurred on buses in the Poole and Bournemouth area – with a picture being released.
Between 10.15am and 11.15am on Saturday, 27 March 2010, a 29-year-old Bournemouth woman was travelling from Boscombe to Poole on a C1 yellow bus when a man sitting behind her touched her left breast. He left the bus near the George roundabout in Poole.
Between 1.41pm and 2.30pm on Saturday, 27 March 2010, a 16-year-old Bournemouth girl was travelling from Poole towards Bournemouth on a C1 yellow bus when a man sitting behind her touched her around the waist. He moved seats after the teenager looked at him and left the bus at the Lansdowne in Bournemouth.
Detective Sergeant Ian Fletcher, of the Bournemouth & Poole public protection unit, said: “I am releasing a picture of a man that I need to speak with as I believe that he may have information that is vital to my investigation.
“I’d like to hear from anyone who recognises the man in the CCTV picture so that I can identify him and speak with him.
“I also believe that all three upsetting incidents were carried out by one man and I am appealing for help from the public to find him.”
The man police are looking for is aged in his late forties to early fifties, five feet nine or ten inches tall and of medium build with a tanned complexion. He was wearing a dark coloured hooded-style duffle jacket.
Detective Sergeant Fletcher continued: “It’s important that I hear from anyone who recognises the man from this description – and from anyone who has any other information that will help me to identify him.”

For the third time in almost as many months, SMART bus has used a Michigan law that puts form over substance to avoid responsibility for causing a bus accident that resulted in serious injuries.
By claiming its accident victims didn’t report their personal injuries (even though the bus line already knew about the injuries and crashes from multiple other sources), SMART bus has successfully argued that victims’ lawsuits should be thrown out of court. SMART bus contends these plaintiffs failed to comply with a Michigan law that requires accident victims to personally notify transportation authorities, such as SMART bus, about their injuries after a bus accident.
In one case, SMART bus used the law to get out of a lawsuit brought by a driver who was smashed by a SMART bus that refused to yield the right of way.
In a second case, SMART bus used the law to shirk its responsibility to a wheelchair-bound passenger whose hip and femur were fractured when a SMART bus negligently turned too sharply.
And, now, in Roberts v. Suburban Mobility Authority for Regional Transportation (SMART), the Michigan Court of Appeals has allowed SMART bus to use the same law to wriggle out of a lawsuit filed by passenger Loren Roberts, who was injured when the SMART bus he was riding started up too fast and caused him to fall to the floor and suffer serious personal injuries.
The law, MCL 124.419, says that any public transportation authority must have “written notice of any claim based upon injury to persons or property shall be served upon the [transportational] authority no later than 60 days from the occurrence through which such injury is sustained …”
SMART’s Most Illogical Extreme
Here, to complete the Alice in Wonderland tale that began in the first two cases, and taking this case to its most illogical extreme, Mr. Roberts actually did provide notice! In fact, he called on the phone and gave a statement to SMART.
Not enough. Not in Michigan and not with our law, that is illogically designed to punish in the most extreme way those people who actually don’t run to a lawyer. How else could any normal Michigan resident know about this law? The sad thing is that most Michigan lawyers, even those who specialize in personal injury and handle a number of car accident cases, don’t even know about the fine print in our law that requires written notice within 60 days for any public bus system in the state.
And sadly, for the third time, it wasn’t enough for Mr. Roberts. The judges in Mr. Roberts’ case said his statements to the bus driver and to the SMART employee over the telephone didn’t amount to the type of notice required by the law. SMART “had notice of an occurrence involving plaintiff, but did not receive notice of a claim … made by the plaintiff,” the judges said.
The fact that Michigan’s bus accident “notice” law allows a wrongdoer like SMART bus to finagle such unfair and absurd results as the ones in Roberts and the other two cases is just plain “dumb.” Again, the public policy behind this law could not be worse. It does nothing to protect Michigan residents or serve the administration of justice and fairness by throwing out cases on loopholes - when SMART already has notice.
Accordingly, changing the law to prevent similar miscarriages of justice in the future is not only the necessary and urgent thing to do. Or the just thing to do. It’s the SMART thing to do as well.

DART BUS HITS BOY ON BIKE
A Des Moines Area Regional Transit Authority bus hit a boy on his bike on Sixth Avenue Tuesday night.
Police said the 13-year-old boy, who has not been identified, was thrown several feet from his bike and suffered a broken leg and facial abrasions but no life-threatening injuries. He was taken to Mercy Medical Center, police said.
The DART bus was traveling south on Sixth Avenue and had a green light at the intersection with Forest Avenue when it hit the boy shortly before 9 p.m., police said.
The boy rode his bicycle across the intersection without stopping, police said.
The driver, Donna Ritchie, was not cited. She has worked for DART for three years and has 18 years of commercial driving experience, DART spokesman Gunnar Olson said. Ritchie has no major accidents on her record, he said.
Des Moines police are investigating the accident. The bus had a camera on board that may show what happened, Olson said.
DART put several new safety initiatives in place following a series of recent accidents involving pedestrians.

STIMULUS TO PROVIDE BRT
Wyandotte County is taking a big step toward starting a high-tech, express bus service between downtown Kansas City and the Village West entertainment complex.
The county has about $12 million in federal stimulus money to put toward a State Avenue line that would be 30 percent faster than existing bus service.
The goal is to take riders from downtown to Village West in 42 minutes. Now it takes 58 minutes.
The new bus rapid transit line on State Avenue would be comparable to the MAX service that runs on Main Street on the Missouri side.
And like the MAX, the Wyandotte County service would have sleek bus shelters with iconic markers and real-time message boards. Buses also would be able to hold traffic signals green to help ensure timely service.
“We’re going a long way,” said Dick Jarrold, the chief engineer for the Kansas City Area Transportation Authority, which is helping to plan the new service.
The money gets Wyandotte County halfway to what it needs to build the rapid bus line. It would go from 10th and Main streets in Kansas City through downtown Kansas City, Kan., and to Village West.
The construction should run $25 million, but $3 million more will be needed each year to operate the system. Construction on some components, such as enhanced bus shelters and new transit centers, will probably start next year.
State Avenue fits into a regional vision of high-end bus service that could one day serve Metcalf Avenue and Shawnee Mission Parkway in Johnson County plus North Oak Trafficway and the U.S. 24/Truman Road corridor in Missouri.
The State Avenue line would run through areas where buses are vital for getting around.
In some places near downtown Kansas City, Kan., about 1 in 5 households are below the poverty level and don’t have cars.
“The key here is getting people to jobs,” Jarrold said. “It’s about connecting people in the eastern part of the corridor to jobs in the western part of the corridor.”
Wyandotte County is still confronted with significant funding challenges, including finding money for finishing construction, plus the money to operate buses 10 minutes apart at certain times of the day. Service on State Avenue now runs every 30 minutes.
Unified Government Mayor Joe Reardon said the bus line won’t be built overnight.
“I am not here to tell you that next year we’re going to have a brand new source of revenue that is going to allow us to solve all the transit problems,” Reardon said in a recent interview.
“But I do believe that we can thoughtfully start to move this as a priority, which is what I’ll advocate for during our budget session.”
Reardon said that regional funding for transit would make the most sense in the long run.
Public transit, he said, “is something that truly ought to tie us all together and it is something that we truly ought to find a way to regionally fund.”

Driver killed when truck slams into school bus
CORPUS CHRISTI, Texas — The driver of a pickup truck is dead after his truck slammed into the rear of a school bus in Corpus Christi.
A Corpus Christi police spokesman says the crash happened about 3:30 p.m. Tuesday in the Flour Bluff section of southeastern Corpus Christi when the truck knifed beneath the bus.
Flour Bluff school district spokeswoman Lynn Kaylor tells the Corpus Christi Caller-Times that none of the 12 young students aboard the bus, nor the driver, were injured.
Police haven't released the name of the man killed.

A Perkiomen Valley school bus driver has been ordered to stand trial on charges of homicide by vehicle and 46 counts of recklessly endangering another person in a crash that killed a passenger in an oncoming car. Frederick Poust III, 38, of Schwenksville, had a preliminary hearing Tuesday in Gilbertsville in the Feb. 17 crash outside the Perkiomen Valley Middle School West in Lower Frederick Township. Pickup Crash Knocks Power Lines Onto Bus
PORTLAND, Ore. -- A pickup truck slammed into a power pole Wednesday in southeast Portland, causing power lines to fall onto a TriMet bus, police said.The only person on the bus at the time was the TriMet driver, according to the transit agency. It did not appear that the driver suffered any injuries.Portland police spokeswoman Mary Wheat said the driver of the pickup suffered a medical condition that caused him to go off the road near Southeast 17th Avenue and Pardee Street.The pickup driver was not injured or cited for his involvement in the wreck.As of 1:30 P.M., PGE crews remained were still at the scene to repair the lines and pole. Traffic signals were out in the area.Southeast 17th Avenue will likely be closed between Holgate and McLoughlin boulevards for several hours as a result of the wreck.
